Welcome to CallMate. These Terms of Service ("Terms") govern your use of the CallMate AI voice receptionist platform and related services ("Services"). By using CallMate, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using CallMate, you agree to these Terms and our Privacy Policy. If you are using CallMate on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Services

CallMate provides AI-powered voice receptionist, SMS booking, web chat, and appointment scheduling services for businesses. Our Services include answering phone calls, booking appointments, sending automated messages, and integrating with third-party calendars.

3. Account Registration

To use CallMate, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use CallMate only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction, including privacy and telecommunications laws
  • Interfere with or disrupt the Services or servers connected to the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to make harassing, threatening, or fraudulent communications
  • Resell or redistribute the Services without our prior written consent

5. Your Responsibilities

You are responsible for:

  • Providing accurate information for your AI receptionist configuration
  • Obtaining necessary consents from your customers for call recording and automated communications
  • Complying with CASL and other applicable anti-spam legislation
  • Ensuring your use of CallMate complies with industry regulations applicable to your business
  • Maintaining accurate knowledge base and service information

6. Subscription and Payment

CallMate offers subscription-based pricing. By subscribing, you agree to pay the applicable fees according to your selected plan. Subscriptions automatically renew unless cancelled before the renewal date.

All fees are in Canadian dollars and subject to applicable taxes. We reserve the right to change our pricing with 30 days notice. Price changes will apply at your next billing cycle.

7. Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will continue to have access to the Services until the end of your current billing period. We offer a 14-day money-back guarantee for new subscriptions.

8. Intellectual Property

CallMate and its licensors retain all rights, title, and interest in the Services, including all intellectual property rights. You are granted a limited, non-exclusive license to use the Services in accordance with these Terms.

Content you provide (knowledge base, business information) remains your property. You grant CallMate a license to use this content solely to provide the Services.

9. Data and Privacy

Your use of CallMate is also governed by our Privacy Policy. By using the Services, you consent to our collection and use of data as described in the Privacy Policy.

10. Service Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may suspend Services for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

11. Limitation of Liability

To the maximum extent permitted by law, CallMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising from your use of the Services.

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amounts you paid to CallMate in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CallMate and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use of CallMate after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Ontario.
